    4. Reliance on suggestions or recommendations from our team
      Our financial liability, if any, will not exceed the total payment received for the concerned service during the three-month period before the claim. All our services are provided “as is” and subject to change based on industry or platform shifts.
  3. Third-Party Technologies
    To fulfill service requirements, we may use external plugins, servers, APIs, or tools. Codener is not responsible for performance disruptions, data inaccuracies, or losses originating from those third-party sources.

6. Termination

Codener reserves the right to suspend or terminate your access to its website and services at any time, with or without notice, for any reason including violation of these terms.

7. Severability and Waiver

If any provision is deemed unenforceable, the remainder will still apply. Our failure to enforce any term is not a waiver of our rights.

8. Pricing, Invoicing, and Payment Terms

  1. All service costs are outlined in the agreed proposal or contract. We typically require upfront or milestone-based payments before project initiation.
  2. Accepted payment methods include bank transfers, wire transfers, and online payment gateways. Currency and any additional transaction fees will be clearly mentioned in your invoice.
  3. Invoices are due upon receipt unless otherwise stated. A late fee of 5% may apply if payments are delayed beyond 7 days from the due date. Continued non-payment may lead to service suspension or termination.

9. Third-Party Tools and Services

  1. Codener may use third-party tools, services, or software such as plugins, APIs, themes, analytics tools, or hosting providers to complete your project.
  2.  We are not liable for any downtime, data loss, bugs, or performance issues resulting from third-party services or updates made by them.
  3. If a premium third-party service is required, the client is responsible for purchasing and maintaining the license unless agreed otherwise.

10. Confidentiality and NDAs

  1. We take your privacy seriously. Every client engagement involves sensitive project details, and we treat all shared information, technical, strategic, or commercial, as confidential by default. Neither Codener nor the client is permitted to disclose such information to any external party without documented approval. This confidentiality extends to shared passwords, login credentials, design documents, product roadmaps, and user analytics.
  2. To add legal protection, we support NDA execution and are open to signing yours or providing our own. These agreements serve to outline the expectations clearly and create a mutual assurance of data protection. Internally, every employee and subcontractor working with us is bound by confidentiality clauses and strict role-based access policies. You can be confident that your project details will remain secure and private from start to finish.

11. Data Privacy

  1. Codener collects and uses personal or business data such as name, contact details, and project information strictly for service delivery, communication, and project management.
  2. We implement secure storage, access controls, and data encryption to safeguard your information, and we do not sell or share your data with third parties unless required for project completion.
  3. Clients are responsible for ensuring that any data shared with Codener, particularly user data, complies with applicable data protection laws like UK GDPR or EU GDPR.

12. Governing Law

These Terms and Conditions are governed by the laws of Pakistan. You agree that the courts located in
Pakistan will have exclusive jurisdiction over any disputes arising from your use of our services.
